Review Two Legal Systems

Obtain U.S. advice about the agreement and parentage process, plus home-country advice about recognition and returning with the child. Permission to pursue an arrangement in one jurisdiction does not establish recognition elsewhere.

Resolve Key Questions Before Committing

Ask qualified advisers to explain the requirements for your citizenship, residence and family circumstances.

  • Will the home country recognize the intended parents and any U.S. parentage order?
  • Are additional parentage, adoption or citizenship procedures needed?
  • Which birth records, certified copies, translations, apostilles or consular documents are required?
  • What immigration, entry and residence permissions apply to the parents and child?

Plan Treatment and Travel

Ask the clinic which visits require attendance and how remote communication or local monitoring works. Discuss delivery attendance, accommodation, contingency travel and support if timing changes. Immigration and document processing can affect the stay after birth.

Prepare the Return-home Documents

Coordinate the parentage order, birth registration and any passport or consular applications with the relevant authorities. Confirm requirements directly rather than assuming U.S. documents guarantee citizenship, recognition or permission to travel.

Keep Your Advisers Informed

Tell your attorney about changes in residence, citizenship, marital status or delivery location. Maintain a document checklist and named contacts for the clinic, hospital, U.S. counsel and home-country counsel.

Practical Questions

Is a child automatically eligible for every parent’s nationality?
No. Nationality and citizenship rules vary and may depend on legal parentage, genetic connection or other requirements. Ask the relevant authorities and counsel about your circumstances.
Can an agency confirm the home-country legal outcome?
The agency can coordinate communication, but home-country recognition and immigration advice must come from qualified professionals and relevant authorities.
How long should we stay after birth?
There is no universal duration. Plan with the hospital, document-issuing authorities and advisers, allowing for unexpected delays before making fixed return plans.
